These Terms & Conditions govern use of the Higher Ground Outdoor Living website and related inquiry communications. “Higher Ground,” “we,” “us,” and “our” refer to Higher Ground Outdoor Living Inc. By using this website, you agree to these terms.
Website Use
You may use this website for lawful informational purposes and to inquire about Higher Ground services. You may not interfere with website operation, attempt unauthorized access, submit false or harmful information, copy protected content for commercial use, or use the website in violation of law.
Website Information
Website content is general information and may be updated without notice. Project descriptions, photographs, examples, and service information do not guarantee that the same scope, materials, pricing, schedule, or result is available for another property.
Estimates Are Not Contracts
Any preliminary estimate, range, budget discussion, or website information is provided for planning purposes and is not a contract, binding offer, or guarantee of final price, scope, start date, or completion date. Site conditions, design decisions, permitting, engineering, selections, availability, and other factors may affect a final proposal.
Proposal Acceptance and Project Agreements
A project proceeds only after Higher Ground issues applicable written proposal or contract documents, the customer accepts them through the stated process, and any required deposit or other conditions are satisfied. The executed proposal, contract, change orders, and incorporated documents control the project and supersede inconsistent website content or preliminary discussions.
Warranty
Warranty coverage is governed by the applicable project documents and the Higher Ground Outdoor Living Warranty Standard in effect for the project. Our current general warranty information is available on the Warranty page. Manufacturer warranties remain subject to each manufacturer’s terms, registration requirements, and exclusions.
SMS Terms
By submitting a website form and checking the consent checkbox, you agree to receive informational text messages from Higher Ground Outdoor Living regarding your project inquiry, consultation scheduling, appointment reminders, project updates, and customer service communications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.

When you submit an inquiry, you authorize Higher Ground to contact you using the information provided for consultation, estimate, scheduling, project, warranty, and customer-service purposes. You may request communication-preference changes at any time.

Website text, graphics, branding, photographs, designs, and other content are owned by Higher Ground or used with permission and may not be reproduced, distributed, or commercially exploited without authorization.
Third-Party Services and Links
The website may use or link to third-party services. Higher Ground is not responsible for third-party websites or their content, availability, or privacy practices. Use of third-party services may be governed by separate terms.
Limitation of Liability
To the fullest extent permitted by law, Higher Ground is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, this website. Higher Ground’s responsibility for construction, design, products, payment, warranty, or other project matters is governed by the executed project documents and applicable law.

The website is provided on an “as available” basis. We do not warrant uninterrupted access or that website content will always be error-free, current, or suitable for every purpose.
Governing Law
These website terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute relating solely to these website terms will be brought in a court of competent jurisdiction in North Carolina, unless applicable project documents require a different lawful process.
Changes and Severability
We may update these terms by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions will continue in effect.
